CFTC asks court to dismiss CME lawsuit over Kalshi bitcoin perpetuals

CME sued on June 18 after the regulator approved Kalshi’s May 29 order. CME’s complaint argues that the CFTC treated the contracts as futures even though, in CME’s view, their structure makes them swaps. The classification determines which rules apply and which venue can offer the product.

A dismissal request is a procedural argument, not a merits win. The judge must decide whether CME has a legally sufficient injury and whether the court should reach the classification question now.

Perpetuals put product design under a microscope

Crypto perpetual contracts typically use funding payments rather than a fixed expiry to keep prices near an index. Traditional futures exchanges have sought to offer similar exposure, while regulators are still drawing lines around margin, settlement and manipulation safeguards.

If the case survives, the court could examine whether the CFTC followed the Commodity Exchange Act when reviewing Kalshi’s filing. If it is dismissed, CME may still pursue administrative or market-based responses, but the approval would face less immediate judicial friction.

The next deadline is CME’s Oct. 2 opposition to the dismissal motion, followed by the CFTC’s reply. Investors should avoid treating the filing as proof that Kalshi’s product is safe, popular or permanently authorized. It is evidence of an agency defending its process and a major exchange challenging the competitive and legal consequences.

The dispute also matters for market structure. More venues offering similar bitcoin exposure could improve choice and liquidity, but fragmented rules can make pricing, margin and customer protections difficult to compare. Court documents should clarify those differences better than promotional descriptions do.
