Crypto firms ask SEC for faster ETF reviews and confidential draft filings

Grayscale and 21Shares said an optional confidential draft process could reduce copycat filings that arrive after a sponsor reveals its structure. Both also asked staff to commit to responses within 45 days. A16z argued that electronic submissions and templated disclosures should make repeated review questions easier to handle.

The central trade-off is speed without weaker scrutiny. A faster calendar could help issuers respond to market demand, but it would not by itself resolve questions about custody, valuation, liquidity, derivatives exposure or investor disclosures.

Market makers push back on rushed launches

Jane Street and Charles Schwab raised concerns that pressure to launch quickly can leave less time for sponsors to get market-maker feedback on fund structure and liquidity. Jane Street proposed requiring at least two authorized participants, the firms that create and redeem ETF shares, at launch.

The SEC's review comes as the agency says artificial intelligence may be contributing to several novel ETF applications that are largely identical. Confidential drafts could reduce public duplication, but they would also make early-stage proposals less visible to competitors, investors and other stakeholders.

The next evidence is the SEC's final process and filing record. Until the agency changes its rules, sponsor requests remain advocacy, not approvals. Investors should distinguish a submitted proposal from a listed product and read the final prospectus for fees, risks, creation mechanics and conflicts.

The debate is consequential because crypto ETPs connect digital-asset demand to regulated brokerage infrastructure. A transparent, repeatable process could reduce delays and uncertainty; a rushed process could shift problems into trading, pricing or redemption. The useful outcome is not simply more launches, but a review system that is faster where the facts are standardized and slower where product risks are genuinely new.
